1. Services Overview

HillPoint provides operational technology (OT) architecture and systems integration consulting for aerospace and defense manufacturers, water and wastewater utilities, and food and beverage and industrial manufacturers. The Site provides information about our services and offers free educational content, including the OT Architecture Breakdown and the Obsolete Controls Risk Checklist, via email opt-in.

2. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to: use the Site in any way that violates applicable law; attempt to gain unauthorized access to any part of the Site; use the Site to transmit malicious code; or scrape, crawl, or otherwise extract data from the Site through automated means without our written permission.

3. Intellectual Property

All content on the Site (including text, graphics, logos, the mountain mark, diagrams, and downloadable materials) is the property of HillPoint Automation LLC or its licensors and is protected by applicable intellectual property laws. You may view and download content for personal, non-commercial use. You may not reproduce, distribute, or create derivative works from Site content without our written permission.

The OT Architecture Breakdown and the Obsolete Controls Risk Checklist PDFs are provided for your internal evaluation purposes. They may not be redistributed, resold, or published without written consent.

4. Consulting Engagements

Consulting services, including architecture audits, engineering SOWs, and recurring support engagements, are governed by separate statements of work and engagement agreements executed between HillPoint and the client. These Terms do not constitute an offer to provide consulting services and do not govern the terms of any consulting engagement.

5. Disclaimer of Warranties

The Site and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Educational content, including the OT Architecture Breakdown, is provided for informational purposes and does not constitute engineering advice for your specific application.

6. Limitation of Liability

To the fullest extent permitted by law, HillPoint Automation LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any content obtained from the Site. Our total liability for any claim related to the Site shall not exceed the amount you paid to us in the twelve months preceding the claim, or $100, whichever is greater.

7. Indemnification

You agree to indemnify and hold harmless HillPoint Automation LLC and its officers, employees, and agents from any claims, losses, or damages arising from your use of the Site or violation of these Terms.

8. Third-Party Links

The Site may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of any third-party sites. Inclusion of a link does not imply endorsement.

9. ITAR and Export Compliance

HillPoint serves clients in the space and defense sector and is aware of International Traffic in Arms Regulations (ITAR) and Export Administration Regulations (EAR) requirements. No ITAR-controlled or export-restricted technical data is published on the Site. All consulting engagements involving controlled information are governed by separate agreements with appropriate compliance provisions.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Brevard County, Florida.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Site after changes constitutes acceptance of the revised Terms.
